Acceptance of Terms
By accessing or using Dizmo's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all visitors, users, and others who access or use our platform.
Service Description
Dizmo provides a productivity and collaboration platform designed to help teams work more efficiently. Our services include project management tools, team communication features, AI-powered workflows, analytics dashboards, and integrations with third-party applications. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.
User Accounts
To access certain features of our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information updated. You agree to notify us immediately of any unauthorized use of your account.
Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these Terms. You may not use our services to transmit harmful code, interfere with the platform's operation, impersonate others, harvest user data without consent, or engage in any activity that violates applicable laws or regulations. We reserve the right to terminate accounts that violate these guidelines.
Intellectual Property
All content, features, and functionality of Dizmo—including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof—are the exclusive property of Dizmo or its licensors and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you create using our platform.
Payment Terms
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth in these Terms or as required by law. We may change our fees upon thirty (30) days' notice. If you do not agree with a fee change, you may cancel your subscription before the change takes effect. Failure to pay may result in suspension or termination of your account.
Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the services will immediately cease. You may also terminate your account at any time by contacting our support team. Provisions that by their nature should survive termination shall survive.
Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. Dizmo does not warrant that the services will be uninterrupted, secure, or error-free. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of our services is at your sole risk.
Limitation of Liability
In no event shall Dizmo, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your access to or use of (or inability to access or use) our services. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of such courts.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically for any changes.
